These General Terms and Conditions regulate the legal relationship between the guest and Hotel Zugertor AG (hereinafter referred to as Hotel Zugertor), unless otherwise agreed. The basis is the reservation/order confirmation or the offer you signed for confirmation.
The present General Terms and Conditions (hereinafter referred to as GTC) apply to the leasing of rooms and to all other related services of the Hotel Zugertor to customers. All offers from Hotel Zugertor are based on the following terms and conditions. They form an integral part of every contract. Should these GTC contradict any contractual terms of a customer, these GTC shall take precedence.
Option data (offers, order confirmations, etc.) are binding for both parties. After the option period has expired, the Hotel Zugertor can automatically dispose of the reserved rooms.
After the reservation has been made by the customer, he will receive a written reservation confirmation from the Hotel Zugertor. The contract between the parties only comes into effect with this written confirmation of reservation from the Hotel Zugertor to the customer.
The Hotel Zugertor reserves the right to ask the customer for credit card details to guarantee the reservation/payment.
The Hotel Zugertor undertakes to provide the services ordered by the customer and promised in writing by the Hotel Zugertor.
All prices are in Swiss francs (CHF) and include the statutory value added tax (VAT).
The Hotel Zugertor is entitled to request a reasonable down payment at any time. The amount of the deposit and the payment dates are agreed in writing in the contract. If the customer does not meet his obligation to make a down payment by the deadline, the Hotel Zugertor is entitled to withdraw from the contract after setting a reasonable grace period. The customer is liable to the Hotel Zugertor for any resulting damage.
If the Hotel Zugertor does not request a deposit, the entire invoice amount must be paid by the customer at the latest by the time of departure by credit card (Mastercard, VISA, American Express, Diners, JCB), debit card (EC/Maestro, Postcard) or in cash. If payment by invoice is agreed, the entire invoice amount is due 10 days after the invoice date. In the event of a delay in payment, the Hotel Zugertor is entitled to charge interest on arrears.
Hotel Zugertor expressly reserves the right to change prices.
The customer is liable to the Hotel Zugertor for all damage and loss or other damage caused by himself, his employees, his agents or other third parties. The Hotel Zugertor accepts no liability for theft or damage to property brought in by the customer or third parties. The Hotel Zugertor can request proof of sufficient insurance from the customer at any time.
The customer is obliged to maintain peace and order. He undertakes to fully indemnify the Hotel Zugertor against all civil and public law claims that are raised against the Hotel Zugertor by authorities or third parties and to pay for all corresponding claims.
The Hotel Zugertor is only liable for intentional or grossly negligent contractual or non-contractual damage and only for direct damage. Any further liability, in particular in the case of slight or medium negligence or for indirect damage, in particular lost profits, is waived.
If the service to be provided by the Hotel Zugertor under the contract is made more difficult or impossible in whole or in part due to force majeure or other circumstances not caused by the Hotel Zugertor, the Hotel Zugertor can withdraw from the part of the contract that has not yet been fulfilled in whole or in part without compensation.
The hotel rooms are available from 3 p.m. on the day of arrival and must be vacated by 11 a.m. on the day of departure at the latest.
The Hotel Zugertor will receive a list of participants with the following information from the customer no later than 21 days before arrival: first and last names of all guests, time of arrival, payment terms for the guests (if these have not already been determined in advance).
After the period set by the Hotel Zugertor has expired, the rooms still available in the respective contingent will be released for open sale again.
The following cancellation conditions apply to the cancellation of bookings as well as no-shows and early departures.
Cancellations of the booking of individual hotel rooms (up to 2 rooms) must reach the Hotel Zugertor by 12:00 p.m. local time on the day before the arrival date at the latest. If you cancel after this deadline 100% cancellation fee will be charged.
The cancellation of a block booking of several hotel rooms (from 3 rooms) must reach the Hotel Zugertor as follows at the latest:
Up to 6 rooms: 14 days before arrival
Up to 10 rooms: 30 days before arrival
From 11 rooms: 42 days before arrival
In the event of cancellation after the above deadlines, the customer will be charged cancellation costs as follows:
Up to 6 rooms:
7-13 days before arrival: 75% of the total amount of the contractually agreed services
6 days or less before arrival: 100% of the total amount of the contracted services
Up to 10 rooms:
11-29 days before arrival: 75% of the total amount of the contractually agreed services
10 days or less before arrival: 100% of the total amount of the contracted services
From 11 rooms:
21-41 days before arrival: 75% of the total amount of the contractually agreed services
20 days or less before arrival: 100% of the total amount of the contracted services
For all cancellations, services provided by the Hotel Zugertor and its partners in advance must always be paid for in full.
The hotel reserves the right to contractually stipulate individual cancellation conditions.
The guest is liable to the Hotel Zugertor for damage and loss caused by him or his assistants, participants or pets, without the Hotel Zugertor having to prove fault. The Hotel Zugertor accepts no liability for theft or damage to materials brought in.
Swiss law is exclusively applicable to the contract. The Cantonal Court of Zug in Zug is the place of jurisdiction. Should individual provisions of these General Terms and Conditions be ineffective, this does not affect the validity of the remaining provisions. In such a case, the legally ineffective provision will be replaced by a similar but effective provision.
